The International Court of Justice (ICJ) delivered its advisory opinion concerning the unilateral declaration of independence by Kosovo on July 22, 2010. Following the disintegration of Yugoslavia in the 1990s, Kosovo, predominantly inhabited by ethnic Albanians, sought independence. This desire for independence came after years of conflict and friction with Serbia, claims that led to significant internal and international tension. In 2008, Kosovo declared independence from Serbia, a move that was met with strong opposition from Serbia and other countries. This declaration ignited a legal debate on whether Kosovo’s move violated international law. Serbia contended that the declaration breached its territorial integrity and the United Nations Security Council Resolution 1244, which established an interim administration for Kosovo under the United Nations. Seeking legal clarification, the United Nations General Assembly requested the ICJ to provide an advisory opinion. The ICJ ruled that there were no prohibitions within international law to declarations of independence. Specifically, the court stated that Kosovo’s declaration did not contravene general international law, Resolution 1244, or the Constitutional Framework adopted by the UN Interim Administration Mission in Kosovo (UNMIK). Historically, this ruling had considerable implications. From a legal perspective, it implied that while international law did not outright prohibit declarations of independence, it did not automatically confer statehood either. The ruling addressed the legality of declarations without making a determination on Kosovo's statehood recognition, leaving the recognition of Kosovo as a sovereign state to individual UN member countries. The ICJ's opinion has impacted global geopolitics, influencing independence movements and international relations. By the time of the ruling, Kosovo had been recognized by over 60 countries. The resolution did not resolve all disputes, as many countries backed Serbia’s stance. It, however, provided strong moral and legal support to Kosovo’s claims of independence.
